It is also part of planning every transport operation.<\/p>\n<p>In February 2026, Spanish legislation governing risk-based inspections and checks on the road transport of dangerous goods was updated, incorporating amendments introduced at European level into Spanish law. The resolution establishes different categories of infringements and identifies situations that may pose a particularly significant risk during transport.<\/p>\n<p>But what can prevent an ADR tanker truck from continuing its journey?<\/p>\n<h2>1. A tank that does not meet the applicable requirements<\/h2>\n<p>Tanks used to transport dangerous goods must comply with the technical and type-approval requirements applicable to the goods and the type of transport concerned.<\/p>\n<p>Using an unsuitable tank, one that has not been type-approved where required, or one that does not meet the applicable conditions may result in a serious infringement during an inspection.<\/p>\n<p>Inspection regulations expressly identify the use of unsuitable or, where required, non-type-approved tanks, vehicles or containment equipment as situations involving a higher level of risk.<\/p>\n<p>Therefore, before loading, it is not enough to check that the vehicle is available.<\/p>\n<p>The vehicle and tank must be suitable for the goods they are intended to carry.<\/p>\n<h2>2. Overdue inspections or tests<\/h2>\n<p>ADR tanks are subject to various inspections and tests throughout their service life.<\/p>\n<p>The dates of these checks must remain within the periods established by the applicable regulations.<\/p>\n<p>Spanish inspection regulations classify failure to comply with inspection and test deadlines, or with the permitted periods of use for tanks, vehicles and other containment equipment, as a risk-related issue.<\/p>\n<p>This makes the management of inspection dates an operational priority.<\/p>\n<p>A check left until the last minute can ultimately affect vehicle availability.<\/p>\n<h2>3. Missing mandatory equipment<\/h2>\n<p>The vehicle must carry the equipment required under the ADR and the written instructions.<\/p>\n<p>Failure to carry the required items on board is also expressly identified as a risk-related infringement in dangerous goods transport inspections.<\/p>\n<p>Pre-departure checks should therefore cover the vehicle&#8217;s equipment as well as its documentation.<\/p>\n<h2>4. Incorrect hazard marking and signage<\/h2>\n<p>Orange-coloured plates, hazard placards, labels, marks and other signage identify the risks associated with the goods being transported.<\/p>\n<p>Missing signage, incorrect positioning or the use of markings that do not correspond to the load may result in an infringement during an inspection.<\/p>\n<p>The updated regulations specifically identify incorrect labels, hazard placards, orange-coloured plates, plates, signs or any other markings on tanks, vehicles and other containment equipment as a risk-related issue.<\/p>\n<p>In other words:<\/p>\n<p>It is not enough for the vehicle to display hazard markings. They must be correct for the operation being carried out.<\/p>\n<h2>5. An improperly closed tank<\/h2>\n<p>In dangerous goods transport, closure systems play an essential role.<\/p>\n<p>Inspection regulations include failure to close tanks, vehicles, containers or packages correctly among the risk-related issues, including where they are empty and uncleaned.<\/p>\n<p>This last point is particularly important because an empty tank is not automatically exempt from certain obligations.<\/p>\n<h3>An empty tank may still be subject to ADR requirements<\/h3>\n<p>The ADR covers empty, uncleaned and ungas-freed tanks under certain transport and marking requirements.<\/p>\n<p>Consequently, completing an unloading operation does not necessarily mean that all transport-related obligations have ceased to apply.<\/p>\n<h2>6. Failure to comply with filling requirements<\/h2>\n<p>Filling a tank does not simply involve loading a particular quantity of product.<\/p>\n<p>The degree of filling must comply with the conditions established for the goods and the type of tank.<\/p>\n<p>Spanish inspection regulations expressly identify failure to comply with the provisions governing the degree or level of filling of tanks as a risk-related issue.<\/p>\n<p>In addition, specific obligations apply during loading and unloading to prevent overfilling and dangerous releases. The loader must check the weight or volume loaded and the degree of filling.<\/p>\n<h2>7. Missing or incorrect transport documentation<\/h2>\n<p>Documentation is another essential element of any ADR operation.<\/p>\n<p>The consignor must provide the carrier with the necessary instructions and information and, where applicable, the consignment note and other documents required under the ADR.<\/p>\n<p>Before transport begins, it is therefore advisable to check that the documentation accurately reflects the goods, vehicle and planned operation.<\/p>\n<p>A documentary error can become an operational problem when the vehicle is stopped for a roadside inspection.<\/p>\n<h2>8. Dangerous goods without the required identification<\/h2>\n<p>Identifying dangerous goods is essential to ensure that the authorities, emergency services and other parties involved in the transport chain can understand the risks associated with the product.<\/p>\n<p>The classification, UN number, proper shipping name and all other required information must therefore be consistent with the goods being transported.<\/p>\n<p>In an ADR operation, the goods, documentation and hazard markings must all tell the same story.<\/p>\n<h2>9. Failure to meet the requirements applicable after unloading<\/h2>\n<p>Unloading does not always mean that a tank is immediately ready to carry any other product.<\/p>\n<p>Since 1 July 2026, significant amendments to the Spanish rules governing the internal cleaning, degassing and depressurisation of tanks used to transport dangerous goods have applied. Among other provisions, Royal Decree 186\/2026 establishes the need for internal cleaning before certain inspections, when changing to an incompatible product and before certain repairs or modifications.<\/p>\n<p>After cleaning, the tank must also be checked to ensure that it is clean and empty, and the cleaning facility must issue a certificate containing the relevant information.<\/p>\n<p>Planning the period between unloading and the next loading operation is therefore also part of ADR tank management.<\/p>\n<h2>10. Failure to account for traffic restrictions<\/h2>\n<p>Not every issue affecting ADR transport is related to the physical condition of the vehicle.<\/p>\n<p>Applicable traffic restrictions and route requirements must also be taken into account.<\/p>\n<p>Traffic regulations establish specific restrictions for certain vehicles carrying dangerous goods displaying orange-coloured plates and provide for designated routes for these transports.<\/p>\n<p>In addition, exceptional circumstances, such as adverse weather conditions or the activation of special civil protection plans, may lead to temporary restrictions on ADR vehicle movements and require vehicles to be parked in safe conditions.<\/p>\n<p>Planning an ADR route therefore involves more than calculating mileage and driving time.<\/p>\n<p>It is also necessary to check where the vehicle is permitted to travel and under what conditions.<\/p>\n<h2>The best way to prepare for an inspection is to get ready before departure<\/h2>\n<p>A roadside inspection should not be the moment when a company discovers that an inspection has expired, that equipment is missing or that the documentation does not match the operation.<\/p>\n<p>Prevention starts before departure.<\/p>\n<p>Dangerous goods transport requires every operation to coordinate the goods, tank, vehicle, documentation, equipment and route.<\/p>\n<p>For international transport, companies must also consider the specific requirements of the different countries through which the vehicle travels.<\/p>\n<p>At Fern\u00e1ndez Aedo, we work in road freight transport, including the carriage of chemicals in tankers and operations between Spain and France.<\/p>\n<p>Because in ADR transport, reaching the destination starts long before the truck takes to the road.<\/p>\n<p>&nbsp;<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A roadside inspection may identify non-compliance that must be rectified before a journey can continue.<\/p>\n","protected":false},"author":1,"featured_media":260812,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_seopress_robots_primary_cat":"none","_seopress_titles_title":"What can cause an ADR tanker truck to be immobilised?","_seopress_titles_desc":"A roadside inspection may identify non-compliance that must be rectified before a journey can continue.","_seopress_robots_index":"","_et_pb_use_builder":"on","_et_pb_old_content":"<h1>La crisis de los conductores de mercanc\u00edas: el reto inminente del transporte<\/h1>\r\n<span style=\"font-weight: 400;\">Los transportistas de mercanc\u00edas tienen un papel clave, ya que son los encargados de garantizar el transporte de bienes y productos necesarios para mantener un correcto funcionamiento de las distintas cadenas de suministros. Este proceso a su vez es esencial para la econom\u00eda del pa\u00eds, ya que asegura el abastecimiento de las empresas y su capacidad para generar empleo e ingresos.\u00a0 <\/span><span style=\"font-weight: 400;\">A pesar de su importancia, esta profesi\u00f3n parece estar en peligro de extinci\u00f3n y esta situaci\u00f3n no parece generar suficiente alarma entre las autoridades pertinentes.<\/span>\r\n\r\n<b>\u00bfSab\u00edas que s\u00f3lo el 6% de los conductores que trabajan en el sector europeo del transporte de mercanc\u00edas por carretera son j\u00f3venes?<\/b>\r\n\r\n<span style=\"font-weight: 400;\">Esta cifra resulta muy alarmante <\/span><span style=\"font-weight: 400;\">y es importante que se tomen medidas inmediatas para evitar que la situaci\u00f3n empeore a\u00fan m\u00e1s.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">En Espa\u00f1a se presenta una situaci\u00f3n similar, el 70% de los transportistas tienen m\u00e1s de 50 a\u00f1os. La brecha existente entre los conductores que se jubilan y los transportistas nuevos que se incorporan en esta profesi\u00f3n sigue aumentando y se espera que esta situaci\u00f3n se triplique en toda Europa. Actualmente, se estima que se necesita contratar a medio mill\u00f3n de conductores, y se prev\u00e9 que la tasa de puestos vacantes para transportistas aumente hasta superar el 60% para el a\u00f1o 2026.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">El problema de la falta de conductores de camiones, que ahora se ha convertido en una emergencia, comienza a ser una preocupaci\u00f3n para los 27 pa\u00edses miembros de la Uni\u00f3n Europea, gracias a las organizaciones del sector que han llamado la atenci\u00f3n sobre ello. En respuesta, la Comisi\u00f3n Europea ha propuesto adelantar la edad m\u00ednima para obtener la licencia de conducir C para veh\u00edculos pesados a los 17 a\u00f1os, permitiendo que los j\u00f3venes conduzcan bajo supervisi\u00f3n hasta los 18 a\u00f1os. Aunque esta medida podr\u00eda ayudar en la actual crisis de falta de conductores, no ser\u00e1 suficiente para solucionar el problema por s\u00ed solo. Adem\u00e1s, en muchos pa\u00edses de la UE se requiere tener m\u00e1s de 21 a\u00f1os para conducir un cami\u00f3n, y en algunos casos incluso m\u00e1s de 24 a\u00f1os.<\/span>\r\n\r\n\u00a0\r\n\r\n<b>\u00bfCu\u00e1l es la titulaci\u00f3n requerida para convertirse en conductor o conductora de un tr\u00e1iler?<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\r\n\r\n\u00a0\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En cuanto a la formaci\u00f3n no reglada :<\/span><\/li>\r\n<\/ul>\r\n<span style=\"font-weight: 400;\">\u00a0El proceso de preparaci\u00f3n suele durar alrededor de un a\u00f1o, e implica la obtenci\u00f3n del carn\u00e9 de conducir B, la superaci\u00f3n del Certificado de Aptitud Profesional (CAP) de 280 horas, y la aprobaci\u00f3n del permiso de conducci\u00f3n C para camiones pesados r\u00edgidos, seguido del C+E para tr\u00e1ileres. La \u00faltima parte de esta formaci\u00f3n, que incluye el CAP y los carn\u00e9s para camiones, puede costar entre 4.000 y 6.000 euros, es decir, aproximadamente lo mismo que estudiar una carrera en una universidad p\u00fablica.<\/span>\r\n\r\n\u00a0\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mediante formaci\u00f3n oficial (Formaci\u00f3n Profesional) :<\/span><\/li>\r\n<\/ul>\r\n<span style=\"font-weight: 400;\">Existen dos alternativas: cursar el Grado Medio de Conducci\u00f3n de Veh\u00edculos de Transporte por Carretera (grado D de FP) u obtener el Certificado de Profesionalidad (grado C de FP).\u00a0\u00a0<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Para la primera alternativa, en Espa\u00f1a, \u00fanicamente hay una decena de centros de FP imparten la formaci\u00f3n de 2.000 horas (dos cursos escolares) para obtener el t\u00edtulo de T\u00e9cnico en Conducci\u00f3n de Veh\u00edculos de Transporte por Carretera, pero esta titulaci\u00f3n no habilita autom\u00e1ticamente para conducir un cami\u00f3n, ya que es necesario obtener los permisos de conducci\u00f3n correspondientes de la DGT. Para la segunda opci\u00f3n, el candidato debe poseer los permisos de conducci\u00f3n de cami\u00f3n antes de iniciar la preparaci\u00f3n del Certificado de Profesionalidad (aproximadamente 400 horas), el cual adem\u00e1s requiere aprobar el examen del CAP.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">No obstante, en el sector del transporte no basta con haber finalizado un ciclo formativo de FP para poder acceder al mercado laboral de forma directa.
